He says that a frontal lesion may confer distinctive changes in disposition and temperment. Most characteristic is a disinhibition with expansive overfamiliarity, tactless, over-talk[at]iveness, childish excitement or prankish and punning social and ethical control may be diminished with lack of concern for the future and for the consequence of actions. Sexual indiscretions and petty misdemeanours may occur, or gross errors of judgement with regard to financial or interpersonal matters. Sometimes there is a marked indifference, even callousness for the feeling of others. Equally lack of anxiety and insight on the part of the patient into his or her condition. Elevation of mood is often seen, namely an empty and fatous euphoria rather than a true elation which communicates to the observer. In other cases the principal changes are a lack of initiative, aspontaneity and a profound slowing of psychomotor activity. Concentration, attention and ability to carry out a planned activity are impaired by these changes but performances on test of formal intelligence is often surprisingly well preserved once the patients cooperation has been secured."

Indigenous Law

Human first came to Australia about 40,000 years ago.

Paleoecological evidence reveal 120,000 years ago a change in firestick farming indicating arrival of Aborigines to Australia.

The Observation of anthropologists and early settler and oral historians of Aboriginal descedants attest to Aboriginal customary law. 1 As with European law, sanctioned and unsanctioned behaviour patterns enjoyed moral and religious underpinnings. For what it is worth, authoritative caselaw also agrees that Aboriginal lore was and is indeed law. 2 The Harder question relates to its coexistance with the predominant system of statutory and common law deemed to stem from white settlement.

The Aborignal customary rules, which were not necessarily uniform, spanned aspects of land law, environmental law, sacred law kinship, marriage, initiation and other parts of family law. And there were sanctions, including spearing designed to cause death in some cases, injury in others, indications of a graduated scheme of public wrongs.

To modern eyes there was a good of self-help, but any student of
English common law or European civil law knows that this is a badge of any legal system especially in its primitive phase. As to processes, there were roles for elders whose word was law in various matters and who, like the judges at common law, were the primary medium for explicating and enforcing the tradition. 3 Indigenous legal systems recognised processes akin to trials. 4 These were rudimentary explorations for truth that put a premium on consensus-seeking dialogue, the bedrock of formal mediation processes that white man's law would embrace with enthuiasm in the late 20th century.

Yet by a western conceit, Indigneous laws and customs were entirely disregarded (by white settlers) until long after occupation of the eastern seaboard which commenced with the arrival of the First Fleet in 1788. The Aboriginal peoples inhabiting Australia were variously ignored, attacked and exploited by the settlers and their descendants. Sometimes they retaliated. Sometimes theyacted in self defence or the assertion of a claim of right (had their evidence been acceptable, which was not until many decades after white settlement). Sometimes they, like the white people, did things that contravened both their own laws and the English law that was haltingly applied to them in the frontier colony. Sometimes they did no more than oppose the encroachment of settlers upon the lands which would not be recognised as theirs until 1992, long after they had been killed or moved away as "trespassers". In Tasmania, there were well-documented incidents of the Van Diemen's Land Company because they had resisted the abduction of their wives or for spearing sheep believing them to be game. 5

In the 1992 Mabo Case the High Court rejected the application of the terra nullus doctrine in Australia. 6

It was declared that native title was capable of surviving the Crown's acquisition of sovereignity and radical title to land in Australia. Sadly, Mabo was a decision whose symbolic impact was not matched by any significant redress of past wrongs. There were two broad reasons. At a practical level, it has proved highly difficult and expensive to identify the content of native laws and customs extant at the time of white settlement. And a legal level, the march of white settlement meant that Crown grants of freehold and other acts of occupation simply overreached native title so that it was incapable of revival. In Brennan J's memorable words: 7

The common law can, by reference to the traditional laws and customs of an indigenous people, identify and protect the native rights and interests to which they gave rise. However, when the tide of history was washed away any real acknowledgment of traditional customs, the foundations of native title has disappeared. A native title which has ceased with the abondoning of laws and customs based on tradition cannot be revived for contemporary recognition.

Mabo is generally seen as a case about land rights, although the judgments recognised the theoretical possibility that other aspects of customary law, including rights to hunt and fish,8 could have survived white settlement. But the criminal law was not one of them, according to Mason CJ in Walker v New South Wales. 9 He held that the principles of equality before the law and the universal language of criminal law statutes left not room for incompatible systems of native law to endure. However, the possibility of a defence based on honest claim of right has been noted 10 and there has been limited recognition of a role for customary punishments to be taken into account when sentencing. 11

Australia is claimed by the Europeans

The Hon Keith Mason AC QC retired as President of New South Wales Court of Appeal in 2007 he is now a visiting fellow at the Univeristy of New South Wales. He is co-author of Mason & Carter's Restitution Law in Australia of which second edition was published in 2008. Keith Mason has been a solicitor, barrister, law reformer, solicitor-general, president of a court of appeal, law teacher and mediator. he has published on topics including judicial method, legal taxonomy, the law of restitution, and the interface of law, morality and religion. Currently he is a visiting professorial fellow at the University of New South Wales and Chancellor of Anglican diocese of Armidale. This work, Lawyers Then and Now, combines the interests of an amateur legal historian with insights drawn from a fortunate life in the law. So it is quiet reasonable to expect he never learnt to use Trove to reasearch old newspapers for 1155, 1435, 1453, 1455, 1493, Laudibiliter, Fall of Constantinople, Romanus Pontifex, Inter Ceatara or Pope's Apology to Oceania. It is likely he never learnt to Google Pope's Apology to Oceania or Papal Exhortation to Oceania. Have you?

In 1493 Pope Alexander VI divided the entire "discovered" and undiscovered world between Portuguese and Spanish spheres of influence. The Treaty of Tordesillas between the two nations, mediated by the Pope the following year, made a smallish adjustment that delivered Brazil to Portugal. The notional line that ran around the globe intersected Australia by the 129th meridian an dcame by degrees to serve the boundary of Western Australia.

When, in 1770, Captain Cook claimed "New South Wales" for the British Corwn, the land area comprised all of the modern New South Wales, Queensland, South Australia, Tasmania, Victoria and the Northern Territory. The western extremity was initially latitude 135 degrees west but was extended to the 129th meridian in 1828, thereby ensuring that demarcation was as n antipodean extension of the pope's line. "Possession" of Western Australia was taken by Captain Stirling in 1829, as far east as the 129th meridian. 21

One suggested reason was respect for the British East India Company which was seen as the inheritor of the shadowy Portugese entitlement in the Indian Ocean. By this reasoning, the land of a medieval pope can be seen as having determined the boundary of modern Western Australia.

In 1642 the Dutch explorer Abel Tasman, sailing under the patronage of the colonial Governor Anthony Van Diemen, claimed the large island to the south of the mainland for the stadholder of the Netherlands. That island would bear his patron's name until 1856 when it was decided that Tasman himself should be honoured this way. The Dutch claim was doubly inchoate: legally, because international law required occupation or "settlement" to accompany such an assertion (at least in rleation to terra nullius as Terra Australia Incognita was then regarded) 22 and pracally, because there was no way that the British would acquisce in such conduct by thie dutch rivals. Whatever their status under international law, these assertions of Dutch sovereignty were never recognised by the British who, interestingly enough called the great southland New Holland. until well into the 19th century.

The process whereby English law was received into Australia has recently received exhaustive study. 23 According to a 1722 decision by the Privy Council 24 and the writings of Williiam Blackstone 25 English law (common law and statute law, so far as applicable) was carried abroad as "birthright" or inheritance by British subjects who settled in overseas dominions. The birthright notion was selectively ignored by early Governors who purported to issue licences and regulations inconsistent with the liberties of the Englishmen. But it was adopted by early decisions of the Supreme Court of New South Wales and has been confirmed by the High Court. 26 Reception was endorsed by colonial legislation which also supplied cut-off date.

New South Wales was originally administered by the Governor assisted by military and naval officers acting under letters patent requiring the application of English criminal law. 27 Civil jurisdiction was imposed as a prorogative act. The constitional bases of gubernatorial and judicial power remained controversial until 1824 when Supreme Courts were established by letters patent in Van Diemen's Land and New South Wales by charters issued under Imperial Legislation. 28 Van Diemens's Land was carved out of New South Wales in 1825 (its name being changed to Tasmania in 1856), Victoria in 1851 and Queensland in 1859. Legislation to constitute a colony in Western Australia was first enacted in 1829. South Australia was proclaimed a seperate settlement in 1836 pursuabt to a British Act that stipulated, among other things, that there were to be no convicts. 29

The first English trial on Australian soil occured just over two weeks after white settlement. On 6 February 1788 the women of the First Fleet landed at Sydney Cove. that evening there was an uproarious celebration that continued over the next couple of days. One of the revellers, a convict named Barsby, was charged with personally abusing a drum major, striking a drummer with a cat of nine tails. 30 (This illustrates two aspects of convict law in Australia: the use of legal processes as a prelude to punishment of the convicts and the savagery of the ensuing sentences.)

Over the next few days the Court of Criminal Jurisdiction determined several cases involving the theft of scarce rations. The condign punishment obviously failed to deter the desperately hungry convicts. On 27 February 1788 a convict named Barrett was convicted and sentenced to death for stealing food rations. 31 Two days later, another convict (Freeman) was also sentenced to death for a similiar crime. 32 It is not clear who was deputed to carry out Freeman's execution but, as he stood at the foot of the gallows, he was informed of the Governor's conditional pardon, the condition being that he become the common executiner. After a little time pondering whether to accept the proposal, he reluctantly agreed and his first official duty was to hang Barrett.

Sometimes the rigours of the English law were neglected or overlooked. The first civil case, was widely hailed as showing the rule of lasw in the convict colony, was a claim two convicts against the master of the ship that had transported them to New South Wales in 1788. The successful action in detinue for the loss of the convicts' luggage resulted in an award of $15. 33 The Deputy Judge Advocate 34 overlooked or turned blind eye to the English law of attaint that if applicable as the High Court of Australia was to rule 190 years later in Dugan's case, 35 would have precluded the plaintiffs (as convicted felons) from both suing and giving sworn evidence during the full period of their transportation. The plaintiff Cable (or Kable) went on to become a constable, then a leading merchant in the colony, though he later fell into deep financial difficulties.

The convicts, soldiers and free settlers who formed the colony did not enjoy all of the rights of their English counterparts. As time went by this became more and more contentious, with calls for trial by jury of "peers", ie non-officers, becoming more and more strident. 36 But other trappings of English common law were applied from the outset, as with the case of Ann Davis who in 1789 was convicted and sentenced to death for stealing from a dwelling house. She claimed to be pregnant and thus incapable of (prompt) execution. A jury of twelve matrons was summoned and it was only when they declared Davis not to be pregnant that she was hanged. 37

Blackstone's birthright princile was not, however, self-enacting. Whether because of ignorance or intent, or because most of life was lived beyond the reach of the law, "what passed for law in the colony often differed strongly from English law and often contradicted it". 38 For example, it was not until 1820 that a European was convicted and executed for the murder of an Aboriginal native; and even here the concern of the authorities was that the accused had breached the protocols of diplomacy as much as broken the law. 39

"ADRIAN, bishop, servant of the servants of God, to his most dearly beloved son in Christ, the illustrious king of the English, greeting and apostolical blessing.[1]

"Laudably and profitably doth your Majesty consider how you may best extend the glory of your name on earth and lay up for yourself an eternal reward in heaven, when, as becomes a Catholic prince, you labour to extend the borders of the Church, to teach the truths of the Christian faith to a rude and unlettered people, and to root out the weeds of vice from the field of the Lord; and to accomplish your design more effectually you crave the advice and assistance of the Apostolic See, and in so doing we are persuaded that the higher are your aims, and the more discreet your proceedings, the greater, under God, will be your success; because, whatever has its origin in ardent faith and in love of religion, always has a prosperous end and issue. Certainly it is beyond a doubt, as your Highness acknowledgeth, that Ireland and all the other islands, on which the Gospel of Christ hath dawned and which have received the knowledge of the Christian faith, belong of right to St Peter and the holy Roman Church. Wherefore we are the more desirous to sow in them the acceptable seed of God's word, because we know that it will be strictly required of us hereafter. "We, therefore, regarding your pious and laudable design with due favour, and graciously assenting to your petition, do hereby declare our will and pleasure, that, for the purpose of enlarging the borders of the Church, setting bounds to the progress of wickedness, reforming evil manners, planting virtue, and increasing the Christian religion, you do enter and take possession of that island, and execute therein whatsoever shall be for God's honour and the welfare of the same.

"And, further, we do also strictly charge and require that the people of that land shall accept you with all honour, and dutifully obey you, as their liege lord, saving only the rights of the churches, which we will have inviolably preserved; and reserving to St Peter and the holy Roman Church the yearly pension of one penny from each house. PRIVILEGE OF POPE ALEXANDER III TO HENRY II, CONFIRMING THE BULL OF ADRIAN, 1172 [2]

"Alexander, bishop, servant of the servants of God, to our well-beloved son in Christ, the illustrious king of the English, health and apostolic benediction.

"Forasmuch as these grants of our predecessors which are known to have been made on reasonable grounds, are worthy to be confirmed by a permanent sanction; We, therefore, following in the footsteps of the late venerable Pope Adrian, and in expectation also of seeing the fruits of our own earnest wishes on this head, ratify and confirm the permission of the said Pope granted you in reference to the dominion of the kingdom of Ireland; (reserving to Blessed Peter and the holy Roman Church, as in England, so also in Ireland, the annual payment of one penny for every house;) to the end that the filthy practices of that land may be abolished, and the barbarous nation which is called by the Christian name, may through your clemency attain unto some decency of manners; and that when the Church of that country which has been hitherto in a disordered state, shall have been reduced to better order, that people may by your means possess for the future the reality as well as the name of the Christian profession."

NOTE.�In recent years the authenticity of Adrian's so-called "Bull" has been disputed by authorities like Cardinal Moran and Cardinal Gasquet. The latter has, in his Monastic Life in the Middle Ages (1922), republished an essay originally printed forty years ago in the Dublin Review for July 1883, without any alterations, although a number of its dates and statements have been challenged by later writers (cf. Miss Kate Norgate's paper in the English Historical Review, vol. viii, pp. 18-52[3]). But none of these writers notices the important fact that through the whole of the Middle Ages and up to late times the Bull was accepted without question as genuine both by the Irish nation and by the Vatican. The Privilege of Pope Alexander III, Adrian's successor, confirmed the Bull, and his letters to the King, to the clergy and bishops of Ireland, and to the nobles, enforced obedience to it. A copy existing in the Book of Leinster, on a fly-leaf (p. 342 of the facsimile), shows that in the thirteenth century, to which date this copy is ascribed, it was looked upon as part of the historical material belonging to that province.

It is most singular that Cardinal Gasquet should state that Pope John XXII was ignorant of the Bull of Adrian. In the Appeal sent by Donal O'Neill and the Irish princes to this Pope, at the time of the invasion of Edward Bruce, they distinctly appeal to this Bull as a reason for the Pope's interference on their behalf. They say: "Adrian IV, your predecessor, an Englishman, more even by affection and prejudice than by birth, blinded by that affection and by the false suggestions of Henry II, King of England, . . . gave the dominion of this our island, by a certain form of words, to that same Henry II, whom he ought better to have stripped of his own, on account of the above crime" (i.e., the murder of St Thomas á Becket). In his reply, consequent on this Irish appeal, the Pope, writing from Avignon to King Edward II, in the second year of his pontificate, to recommend to him the advisability of dealing more leniently with his Irish subjects, himself refers to Adrian's Bull as follows: [4] "Know then, Son, that we have received a certain letter directed in the first instance from the Irish nobles and people to our sons Anselm, presbyter, of the title SS. Marcellinus and Peter, and Luke, deacon of St Mary's in the Broadway, Cardinal Nuncios of the apostolic see, and by them enclosed to us in a letter of their own.[5] In which we see it stated, among other things, that whereas our predecessor Pope Adrian of happy memory, did, in a certain mode and form of grant, which was distinctly specified in his apostolic letters drawn up in that behalf, convey to your progenitor, Henry, King of England, of illustrious memory, the supreme dominion over Ireland, that king himself and the kings of England his successors, even to the present time failing to observe the mode and form so set forth, have in direct violation of them, for a long period past kept down that people in a state of intolerable bondage, accompanied with unheard-of hardships and grievances. Nor was there found during all that time, any person to redress the grievances they endured or be moved with a pitiful compassion for their distress; although recourse was had to you . . . and the loud cry of the oppressed fell, at times at least, upon your own ear. In consequence whereof, unable to support such a state of things any longer, they have been compelled to withdraw themselves from your jurisdiction and to invite another to come and be ruler over them," etc.

It is clear that in the early fourteenth century both the Irish and the Popes believed the grant of Adrian to have been genuine. The appeal of O'Neill founds its complaint on the fact that the English kings had not fulfilled the conditions on which the grant was made: it does not dispute the grant. Moreover this epistle of the Pope, as also the Bull, are quoted in full by two of the greatest of Irish ecclesiastical authorities, David Rothe, Bishop of Ossory, in his Analecta Sacra (1616), when he was secretary at Rome to the Primate, Peter Lombard, and by the Primate himself in his book De Regno Hiberniae (1632).[6] He was long resident in Rome and in close touch with the Papal Court, and his book is dedicated to Pope Urban VIII. Neither of these men had any doubt of the genuineness of the document. A later example of the Papal recognition of the Bull is found in the letter of instructions given by Pope Innocent X to the nuncio Rinuccini, when he was sent from Rome to Ireland during the Confederate Wars in 1645. It contains a brief summary of English dealings with Ireland in the past. In it occur the words: "Henry, desiring to strengthen his empire, . . . wished to subdue the island of Ireland; and to compass this design, had recourse to Adrian, who, himself an Englishman, with a liberal hand granted all he coveted. The zeal manifested by Henry to convert all Ireland to the faith moved the soul of Adrian to invest him with the sovereignty of the island," etc. [7] It is clear that later Popes did not disavow Adrian's act. Nor is the distinction attempted to be drawn by some modern writers between the "Donation" and the "Bull" visible in the writings of these authorities. The so-called Bull was an expression of approval and benediction of Henry's action similar to that bestowed by an earlier Pope on Duke William when he proposed to add the crown of England to his dukedom of Normandy, or to the approval by another Pope of John's visit to Ireland, symbolized by the gift of a crown of peacock's feathers. Pope Alexander's three epistles in 1172 declare that when he heard that Henry, "instigated by divine inspiration," had subjected the Irish people to his dominion he had "returned thanks to Him who had conferred so great a victory." He "has learned with joy" that the Irish kings have taken Henry as their sovereign and he exhorts them to fidelity.[8] His legate, Vivianus, at the synod of Dublin immediately afterward "made a public declaration of the right of the king of England to Ireland" and threatened excommunication against all "who presumed to forfeit their allegiance," an attitude persevered in by the Papal See up to the reign of Elizabeth, when the Reformation introduced new considerations.

The gift of Adrian was partly a consequence of the fatherly concern felt by the Pope for the spiritual welfare of the Irish people, of the moral and spiritual condition of whom St Malachy and St Bernard had recently given a desponding report, and it was partly a move in that Weltpolitik which was gradually extending the power of the Roman curia over every part of Europe. At a far later date Pope Alexander VI put forth a similar claim in his division of the entire Western world between Spain and Portugal. These gifts, while extending the Papal support to the recipients in their ambitious projects, at the same time gave expression to the assumption of an authority which claimed to stand above kings and made them suppliants at the hands of the spiritual power.

Sicut Dudum [English: "Just As Long Ago"] is a papal bull promulgated by Pope Eugene IV in Florence on January 13, 1435, which forbade the enslavement of local natives in the Canary Islands who had converted to Christianity.

Background[edit]

Christianity had gained many converts in the Canary Islands by the early 1430s; however, the ownership of the lands had been the subject of dispute between Portugal and the Kingdom of Castille. The lack of effective control had resulted in periodic raids on the islands to procure slaves. Pope Eugene IV was concerned that the enslavement of newly baptized Christians would impede the spread of Christianity and therefore issued the Papal Bull, "Creator Omnium", on 17 December 1434.^[1]

Eugene excommunicated anyone who enslaved newly converted Christians, but no protection was offered to those who declined to become a Christian. Historian Richard Raiswell[1] sees this as a significant turning point because prior to this Canon Law had only sanctioned slavery in the context of a just war and un-baptized captives, but with the issuing of this bull the only protection offered was if the person became a Christian.^[1]

Sicut Dudum[edit]

Portuguese soldiers continued to raid the islands during 1435 and Eugene issued a further edict (Sicut Dudum) that prohibited wars being waged against the islands and affirming the ban on enslavement.^[1]Eugene condemned the enslavement of the peoples of the newly colonized Canary Islands and, under pain of excommunication, ordered all such slaves to be immediately set free.^[2] Joel S Panzer (2008) views "Sicut Dudum" as a significant condemnation of slavery, issued sixty years before the Europeans found the New World.^[3]

Eugene tempered "Sicut Dudum" with another bull (15 September 1436) due to the complaints made by King Duarte of Portugal, now allowing the Portuguese to conquer any unconverted parts of the Canary Islands. According to Raiswell (1997) any Christian would be protected by the earlier edict but the un-baptized were implicitly allowed to be enslaved.^[4] Luis N. Rivera (1992) argues that Eugene's subsequent bull assumes that all Africans are pagans or Saracens and are therefore "enemies of God," language that Nicholas V would reflect later in Romanus Pontifex in which the same groups are described as "enemies of Christ," that they should be reduced to "perpetual servitude".^[5]

To our venerable brothers, peace and apostolic benediction, etcetera.

1. Not long ago, we learned from our brother Ferdinand, bishop at Rubicon and representative of the faithful who are residents of the Canary Islands, and from messengers sent by them to the Apostolic See, and from other trustworthy informers, the following facts: in the said islands—some called Lanzarote—and other nearby islands, the inhabitants, imitating the natural law alone, and not having known previously any sect of apostates or heretics, have a short time since been led into the Orthodox Catholic Faith with the aid of God’s mercy. Nevertheless, with the passage of time, it has happened that in some of the said islands, because of a lack of suitable governors and defenders to direct those who live there to a proper observance of the Faith in things spiritual and temporal, and to protect valiantly their property and goods, some Christians (we speak of this with sorrow), with fictitious reasoning and seizing and opportunity, have approached said islands by ship, and with armed forces taken captive and even carried off to lands overseas very many persons of both sexes, taking advantage of their simplicity.

2. Some of these people were already baptized; others were even at times tricked and deceived by the promise of Baptism, having been made a promise of safety that was not kept. They have deprived the natives of the property, or turned it to their own use, and have subjected some of the inhabitants of said islands to perpetual slavery, sold them to other persons, and committed other various illicit and evil deeds against them, because of which very many of those remaining on said islands, and condemning such slavery, have remained involved in their former errors, having drawn back their intention to receive Baptism, thus offending the majesty of God, putting their souls in danger, and causing no little harm to the Christian religion

3. Therefore, We, to whom it pertains, especially in respect to the aforesaid matters, to rebuke each sinner about his sin, and not wishing to pass by dissimulating, and desiring—as is expected from the pastoral office we hold—as far as possible, to provide salutarily, with a holy and fatherly concern, for the sufferings of the inhabitants, beseech the Lord, and exhort, through the sprinkling of the Blood of Jesus Christ shed for their sins, one and all, temporal princes, lords, captains, armed men, barons, soldiers, nobles, communities, and all others of every kind among the Christian faithful of whatever state, grade, or condition, that they themselves desist from the aforementioned deeds, cause those subject to them to desist from them, and restrain them rigorously.

4. And no less do We order and command all and each of the faithful of each sex, within the space of fifteen days of the publication of these letters in the place where they live, that they restore to their earlier liberty all and each person of either sex who were once residents of said Canary Islands, and made captives since the time of their capture, and who have been made subject to slavery. These people are to be totally and perpetually free, and are to be let go without the exaction or reception of money. If this is not done when the fifteen days have passed, they incur the sentence of excommunication by the act itself, from which they cannot be absolved, except at the point of death, even by the Holy See, or by any Spanish bishop, or by the aforementioned Ferdinand, unless they have first given freedom to these captive persons and restored their goods. We will that like sentence of excommunication be incurred by one and all who attempt to capture, sell, or subject to slavery, baptized residents if the Canary Islands, or those who are freely seeking Baptism, from which excommunication cannot be absolved except as was stated above.

5. Those who humbly and efficaciously obey these, our exhortations and commands deserve, in addition to our favor, and that of the Apostolic See, and the blessings which follow there from, but are to be possessors of eternal happiness and to be placed at the right hand of God, etcetera

Background

The kingdoms of Portugal and Castile had been jockeying for position and possession of colonial territories along the African coast for more than a century prior to Columbus' "discovery" of lands in the western seas. On the theory that the Pope was an arbitrator between nations, each kingdom had sought and obtained Papal bulls at various times to bolster its claims, on the grounds that its activities served to spread Christianity.

The bull Romanus Pontifex is an important example of the Papacy's claim to spiritual lordship of the whole world and of its role in regulating relations among Christian princes and between Christians and "unbelievers" ("heathens" and "infidels"). This bull became the basis for Portugal's later claim to lands in the "new world," a claim which was countered by Castile and the bull Inter caetera in 1493.

An English translation of Romanus Pontifex is reproduced below, as published in European Treaties bearing on the History of the United States and its Dependencies to 1648, Frances Gardiner Davenport, editor, Carnegie Institution of Washington, 1917, Washington, D.C., at pp. 20-26. English Translation

Nicholas, bishop, servant of the servants of God. for a perpetual remembrance.

The Roman pontiff, successor of the key-bearer of the heavenly kingdom and vicar of Jesus Christ, contemplating with a father's mind all the several climes of the world and the characteristics of all the nations dwelling in them and seeking and desiring the salvation of all, wholesomely ordains and disposes upon careful deliberation those things which he sees will be agreeable to the Divine Majesty and by which he may bring the sheep entrusted to him by God into the single divine fold, and may acquire for them the reward of eternal felicity, and obtain pardon for their souls. This we believe will more certainly come to pass, through the aid of the Lord, if we bestow suitable favors and special graces on those Catholic kings and princes, who, like athletes and intrepid champions of the Christian faith, as we know by the evidence of facts, not only restrain the savage excesses of the Saracens and of other infidels, enemies of the Christian name, but also for the defense and increase of the faith vanquish them and their kingdoms and habitations, though situated in the remotest parts unknown to us, and subject them to their own temporal dominion, sparing no labor and expense, in order that those kings and princes, relieved of all obstacles, may be the more animated to the prosecution of so salutary and laudable a work.

We have lately heard, not without great joy and gratification, how our beloved son, the noble personage Henry, infante of Portugal, uncle of our most dear son in Christ, the illustrious Alfonso, king of the kingdoms of Portugal and Algarve, treading in the footsteps of John, of famous memory, king of the said kingdoms, his father, and greatly inflamed with zeal for the salvation of souls and with fervor of faith, as a Catholic and true soldier of Christ, the Creator of all things, and a most active and courageous defender and intrepid champion of the faith in Him, has aspired from his early youth with his utmost might to cause the most glorious name of the said Creator to be published, extolled, and revered throughout the whole world, even in the most remote and undiscovered places, and also to bring into the bosom of his faith the perfidious enemies of him and of the life-giving Cross by which we have been redeemed, namely the Saracens and all other infidels whatsoever, [and how] after the city of Ceuta, situated in Africa, had been subdued by the said King John to his dominion, and after many wars had been waged, sometimes in person, by the said infante, although in the name of the said King John, against the enemies and infidels aforesaid, not without the greatest labors and expense, and with dangers and loss of life and property, and the slaughter of very many of their natural subjects, the said infante being neither enfeebled nor terrified by so many and great labors, dangers, and losses, but growing daily more and more zealous in prosecuting this his so laudable and pious purpose, has peopled with orthodox Christians certain solitary islands in the ocean sea, and has caused churches and other pious places to be there founded and built, in which divine service is celebrated. Also by the laudable endeavor and industry of the said infante, very many inhabitants or dwellers in divers islands situated in the said sea, coming to the knowledge of the true God, have received holy baptism, to the praise and glory of God, the salvation of the souls of many, the propagation also of the orthodox faith, and the increase of divine worship.

Moreover, since, some time ago, it had come to the knowledge of the said infante that never, or at least not within the memory of men, had it been customary to sail on this ocean sea toward the southern and eastern shores, and that it was so unknown to us westerners that we had no certain knowledge of the peoples of those parts, believing that he would best perform his duty to God in this matter, if by his effort and industry that sea might become navigable as far as to the Indians who are said to worship the name of Christ, and that thus he might be able to enter into relation with them, and to incite them to aid the Christians against the Saracens and other such enemies of the faith, and might also be able forthwith to subdue certain gentile or pagan peoples, living between, who are entirely free from infection by the sect of the most impious Mahomet, and to preach and cause to be preached to them the unknown but most sacred name of Christ, strengthened, however, always by the royal authority, he has not ceased for twenty-five years past to send almost yearly an army of the peoples of the said kingdoms with the greatest labor, danger, and expense, in very swift ships called caravels, to explore the sea and coast lands toward the south and the Antarctic pole. And so it came to pass that when a number of ships of this kind had explored and taken possession of very many harbors, islands, and seas, they at length came to the province of Guinea, and having taken possession of some islands and harbors and the sea adjacent to that province, sailing farther they came to the mouth of a certain great river commonly supposed to be the Nile, and war was waged for some years against the peoples of those parts in the name of the said King Alfonso and of the infante, and in it very many islands in that neighborhood were subdued and peacefully possessed, as they are still possessed together with the adjacent sea. Thence also many Guineamen and other negroes, taken by force, and some by barter of unprohibited articles, or by other lawful contract of purchase, have been sent to the said kingdoms. A large number of these have been converted to the Catholic faith, and it is hoped, by the help of divine mercy, that if such progress be continued with them, either those peoples will be converted to the faith or at least the souls of many of them will be gained for Christ.

But since, as we are informed, although the king and infante aforesaid (who with so many and so great dangers, labors, and expenses, and also with loss of so many natives of their said kingdoms, very many of whom have perished in those expeditions, depending only upon the aid of those natives, have caused those provinces to be explored and have acquired and possessed such harbors, islands, and seas, as aforesaid, as the true lords of them), fearing lest strangers induced by covetousness should sail to those parts, and desiring to usurp to themselves the perfection, fruit, and praise of this work, or at least to hinder it, should therefore, either for the sake of gain or through malice, carry or transmit iron, arms, wood used for construction, and other things and goods prohibited to be carried to infidels or should teach those infidels the art of navigation, whereby they would become more powerful and obstinate enemies to the king and infante, and the prosecution of this enterprise would either be hindered, or would perhaps entirely fail, not without great offense to God and great reproach to all Christianity, to prevent this and to conserve their right and possession, [the said king and infante] under certain most severe penalties then expressed, have prohibited and in general have ordained that none, unless with their sailors and ships and on payment of a certain tribute and with an express license previously obtained from the said king or infante, should presume to sail to the said provinces or to trade in their ports or to fish in the sea, [although the king and infante have taken this action, yet in time it might happen that persons of other kingdoms or nations, led by envy, malice, or covetousness, might presume, contrary to the prohibition aforesaid, without license and payment of such tribute, to go to the said provinces, and in the provinces, harbors, islands, and sea, so acquired, to sail, trade, and fish; and thereupon between King Alfonso and the infante, who would by no means suffer themselves to be so trifled with in these things, and the presumptuous persons aforesaid, very many hatreds, rancors, dissensions, wars, and scandals, to the highest offense of God and danger of souls, probably might and would ensue -- We [therefore] weighing all and singular the premises with due meditation, and noting that since we had formerly by other letters of ours granted among other things free and ample faculty to the aforesaid King Alfonso -- to invade, search out, capture, vanquish, and subdue all Saracens and pagans whatsoever, and other enemies of Christ wheresoever placed, and the kingdoms, dukedoms, principalities, dominions, possessions, and all movable and immovable goods whatsoever held and possessed by them and to reduce their persons to perpetual slavery, and to apply and appropriate to himself and his successors the kingdoms, dukedoms, counties, principalities, dominions, possessions, and goods, and to convert them to his and their use and profit -- by having secured the said faculty, the said King Alfonso, or, by his authority, the aforesaid infante, justly and lawfully has acquired and possessed, and doth possess, these islands, lands, harbors, and seas, and they do of right belong and pertain to the said King Alfonso and his successors, nor without special license from King Alfonso and his successors themselves has any other even of the faithful of Christ been entitled hitherto, nor is he by any means now entitled lawfully to meddle therewith -- in order that King Alfonso himself and his successors and the infante.may be able the more zealously to pursue and may pursue this most pious and noble work, and most worthy of perpetual remembrance (which, since the salvation of souls, increase of the faith, and overthrow of its enemies may be procured thereby, we regard as a work wherein the glory of God, and faith in Him, and His commonwealth, the Universal Church, are concerned) in proportion as they, having been relieved of all the greater obstacles, shall find themselves supported by us and by the Apostolic See with favors and graces -- we, being very fully informed of all and singular the premises, do, motu proprio, not at the instance of King Alfonso or the infante, or on the petition of any other offered to us on their behalf in respect to this matter, and after mature deliberation, by apostolic authority, and from certain knowledge, in the fullness of apostolic power, by the tenor of these presents decree and declare that the aforesaid letters of faculty (the tenor whereof we wish to be considered as inserted word for word in these presents, with all and singular the clauses therein contained) are extended to Ceuta and to the aforesaid and all other acquisitions whatsoever, even those acquired before the date of the said letters of faculty, and to all those provinces, islands, harbors, and seas whatsoever, which hereafter, in the name of the said King Alfonso and of his successors and of the infante, in those parts and the adjoining, and in the more distant and remote parts, can be acquired from the hands of infidels or pagans, and that they are comprehended under the said letters of faculty. And by force of those and of the present letters of faculty the acquisitions already made, and what hereafter shall happen to be acquired, after they shall have been acquired, we do by the tenor of these presents decree and declare have pertained, and forever of right do belong and pertain, to the aforesaid king and to his successors and to the infante, and that the right of conquest which in the course of these letters we declare to be extended from the capes of Bojador and of Não, as far as through all Guinea, and beyond toward that southern shore, has belonged and pertained, and forever of right belongs and pertains, to the said King Alfonso, his successors, and the infante, and not to any others. We also by the tenor of these presents decree and declare that King Alfonso and his successors and the infante aforesaid might and may, now and henceforth, freely and lawfully, in these [acquisitions] and concerning them make any prohibitions, statutes, and decrees whatsoever, even penal ones, and with imposition of any tribute, and dispose and ordain concerning them as concerning their own property and their other dominions. And in order to confer a more effectual right and assurance we do by these presents forever give, grant, and appropriate to the aforesaid King Alfonso and his successors, kings of the said kingdoms, and to the infante, the provinces, islands, harbors, places, and seas whatsoever, how many soever, and of what sort soever they shall be, that have already been acquired and that shall hereafter come to be acquired, and the right of conquest also from the capes of Bojador and of Não aforesaid.

Moreover, since this is fitting in many ways for the perfecting of a work of this kind, we allow that the aforesaid King Alfonso and [his] successors and the infante, as also the persons to whom they, or any one of them, shall think that this work ought to be committed, may (according to the grant made to the said King John by Martin V., of happy memory, and another grant made also to King Edward of illustrious memory, king of the same kingdoms, father of the said King Alfonso, by Eugenius IV., of pious memory, Roman pontiffs, our predecessors) make purchases and sales of any things and goods and victuals whatsoever, as it shall seem fit, with any Saracens and infidels, in the said regions; and also may enter into any contracts, transact business, bargain, buy and negotiate, and carry any commodities whatsoever to the places of those Saracens and infidels, provided they be not iron instruments, wood to be used for construction, cordage, ships, or any kinds of armor, and may sell them to the said Saracens and infidels; and also may do, perform, or prosecute all other and singular things [mentioned] in the premises, and things suitable or necessary in relation to these; and that the same King Alfonso, his successors, and the infante, in the provinces, islands, and places already acquired, and to be acquired by him, may found and [cause to be] founded and built any churches, monasteries, or other pious places whatsoever; and also may send over to them any ecclesiastical persons whatsoever, as volunteers, both seculars, and regulars of any of the mendicant orders (with license, however, from their superiors), and that those persons may abide there as long as they shall live, and hear confessions of all who live in the said parts or who come thither, and after the confessions have been heard they may give due absolution in all cases, except those reserved to the aforesaid see, and enjoin salutary penance, and also administer the ecclesiastical sacraments freely and lawfully, and this we allow and grant to Alfonso himself, and his successors, the kings of Portugal, who shall come afterwards, and to the aforesaid infante. Moreover, we entreat in the Lord, and by the sprinkling of the blood of our Lord Jesus Christ, whom, as has been said, it concerneth, we exhort, and as they hope for the remission of their sins enjoin, and also by this perpetual edict of prohibition we more strictly inhibit, all and singular the faithful of Christ, ecclesiastics, seculars, and regulars of whatsoever orders, in whatsoever part of the world they live, and of whatsoever state, degree, order, condition, or pre-eminence they shall be, although endued with archiepiscopal, episcopal, imperial, royal, queenly, ducal, or any other greater ecclesiastical or worldly dignity, that they do not by any means presume to carry arms, iron, wood for construction, and other things prohibited by law from being in any way carried to the Saracens, to any of the provinces, islands, harbors, seas, and places whatsoever, acquired or possessed in the name of King Alfonso, or situated in this conquest or elsewhere, to the Saracens, infidels, or pagans; or even without special license from the said King Alfonso and his successors and the infante, to carry or cause to be carried merchandise and other things permitted by law, or to navigate or cause to be navigated those seas, or to fish in them, or to meddle with the provinces, islands, harbors, seas, and places, or any of them, or with this conquest, or to do anything by themselves or another or others, directly or indirectly, by deed or counsel, or to offer any obstruction whereby the aforesaid King Alfonso and his successors and the infante may be hindered from quietly enjoying their acquisitions and possessions, and prosecuting and carrying out this conquest.

And we decree that whosoever shall infringe these orders [shall incur the following penalties], besides the punishments pronounced by law against those who carry arms and other prohibited things to any of the Saracens, which we wish them to incur by so doing; if they be single persons, they shall incur the sentence of excommunication; if a community or corporation of a city, castle, village, or place, that city, castle, village, or place shall be thereby subject to the interdict; and we decree further that transgressors, collectively or individually, shall not be absolved from the sentence of excommunication, nor be able to obtain the relaxation of this interdict, by apostolic or any other authority, unless they shall first have made due satisfaction for their transgressions to Alfonso himself and his successors and to the infante, or shall have amicably agreed with them thereupon. By [these] apostolic writings we enjoin our venerable brothers, the archbishop of Lisbon, and the bishops of Silves and Ceuta, that they, or two or one of them, by himself, or another or others, as often as they or any of them shall be required on the part of the aforesaid King Alfonso and his successors and the infante or any one of them, on Sundays, and other festival days, in the churches, while a large multitude of people shall assemble there for divine worship, do declare and denounce by apostolic authority that those persons who have been proved to have incurred such sentences of excommunication and interdict, are excommunicated and interdicted, and have been and are involved in the other punishments aforesaid. And we decree that they shall also cause them to be denounced by others, and to be strictly avoided by all, till they shall have made satisfaction for or compromised their transgressions as aforesaid. Offenders are to be held in check by ecclesiastical censure, without regard to appeal, the apostolic constitutions and ordinances and all other things whatsoever to the contrary notwithstanding. But in order that the present letters, which have been issued by us of our certain knowledge and after mature deliberation thereupon, as is aforesaid, may not hereafter be impugned by anyone as fraudulent, secret, or void, we will, and by the authority, knowledge, and power aforementioned, we do likewise by these letters, decree and declare that the said letters and what is contained therein cannot in any wise be impugned, or the effect thereof hindered or obstructed, on account of any defect of fraudulency, secrecy, or nullity, not even from a defect of the ordinary or of any other authority, or from any other defect, but that they shall be valid forever and shall obtain full authority. And if anyone, by whatever authority, shall, wittingly or unwittingly, attempt anything inconsistent with these orders we decree that his act shall be null and void. Moreover, because it would be difficult to carry our present letters to all places whatsoever, we will, and by the said authority we decree by these letters, that faith shall be given as fully and permanently to copies of them, certified under the hand of a notary public and the seal of the episcopal or any superior ecclesiastical court, as if the said original letters were exhibited or shown; and we decree that within two months from the day when these present letters, or the paper or parchment containing the tenor of the same, shall be affixed to the doors of the church at Lisbon, the sentences of excommunication and the other sentences contained therein shall bind all and singular offenders as fully as if these present letters had been made known and presented to them in person and lawfully. Therefore let no one infringe or with rash boldness contravene this our declaration, constitution, gift, grant, appropriation, decree, supplication, exhortation, injunction, inhibition, mandate, and will. But if anyone should presume to do so, be it known to him that he will incur the wrath of Almighty God and of the blessed apostles Peter and Paul. Given at Rome, at Saint Peter's, on the eighth day of January, in the year of the incarnation of our Lord one thousand four hundred and fifty-four, and in the eighth year of our pontificate.

The Bull Inter Caetera (Alexander VI), May 4, 1493.

Background

Columbus' discovery in 1492 of supposedly Asiatic lands in the western seas threatened the unstable relations between the kingdoms of Portugal and Castile, which had been jockeying for position and possession of colonial territories along the African coast for many years. The king of Portugal asserted that the discovery was within the bounds set forth in Papal bulls of 1455, 1456, and 1479. The king and queen of Castile disputed this and sought a new Papal Bull on the subject.

Pope Alexander VI, a native of Valencia and a friend of the Castilian king, responded with three bulls, dated May 3 and 4, which were highly favorable to Castile. The third of these bulls, the bull Inter caetera, is reproduced below, in an English translation published in European Treaties bearing on the History of the United States and its Dependencies to 1648, Frances Gardiner Davenport, editor, Carnegie Institution of Washington, 1917, Washington, D.C., at pp. 75-78. The original text in Latin is in the same volume, at pp. 72-75.

Though later bulls were issued on the subject of Portugese and Spanish colonial rivalry, the bull Inter caetera became a major document in the development of subsequent legal doctrines regarding claims of empire in the "new world." The bull assigned to Castile the exclusive right to acquire territory, to trade in, or even to approach the lands lying west of the meridian situated one hundred leagues west of the Azores and Cape Verde Islands. An exception was made, however, for any lands actually possessed by any other Christian prince beyond this meridian prior to Christmas, 1492.

English Translation

Alexander, bishop, servant of the servants of God, to the illustrious sovereigns, our very dear son in Christ, Ferdinand, king, and our very dear daughter in Christ, Isabella, queen of Castile, Leon, Aragon, Sicily, and Granada, health and apostolic benediction. Among other works well pleasing to the Divine Majesty and cherished of our heart, this assuredly ranks highest, that in our times especially the Catholic faith and the Christian religion be exalted and be everywhere increased and spread, that the health of souls be cared for and that barbarous nations be overthrown and brought to the faith itself. Wherefore inasmuch as by the favor of divine clemency, we, though of insufficient merits, have been called to this Holy See of Peter, recognizing that as true Catholic kings and princes, such as we have known you always to be, and as your illustrious deeds already known to almost the whole world declare, you not only eagerly desire but with every effort, zeal, and diligence, without regard to hardships, expenses, dangers, with the shedding even of your blood, are laboring to that end; recognizing also that you have long since dedicated to this purpose your whole soul and all your endeavors -- as witnessed in these times with so much glory to the Divine Name in your recovery of the kingdom of Granada from the yoke of the Saracens -- we therefore are rightly led, and hold it as our duty, to grant you even of our own accord and in your favor those things whereby with effort each day more hearty you may be enabled for the honor of God himself and the spread of the Christian rule to carry forward your holy and praiseworthy purpose so pleasing to immortal God. We have indeed learned that you, who for a long time had intended to seek out and discover certain islands and mainlands remote and unknown and not hitherto discovered by others, to the end that you might bring to the worship of our Redeemer and the profession of the Catholic faith their residents and inhabitants, having been up to the present time greatly engaged in the siege and recovery of the kingdom itself of Granada were unable to accomplish this holy and praiseworthy purpose; but the said kingdom having at length been regained, as was pleasing to the Lord, you, with the wish to fulfill your desire, chose our beloved son, Christopher Columbus, a man assuredly worthy and of the highest recommendations and fitted for so great an undertaking, whom you furnished with ships and men equipped for like designs, not without the greatest hardships, dangers, and expenses, to make diligent quest for these remote and unknown mainlands and islands through the sea, where hitherto no one had sailed; and they at length, with divine aid and with the utmost diligence sailing in the ocean sea, discovered certain very remote islands and even mainlands that hitherto had not been discovered by others; wherein dwell very many peoples living in peace, and, as reported, going unclothed, and not eating flesh. Moreover, as your aforesaid envoys are of opinion, these very peoples living in the said islands and countries believe in one God, the Creator in heaven, and seem sufficiently disposed to embrace the Catholic faith and be trained in good morals. And it is hoped that, were they instructed, the name of the Savior, our Lord Jesus Christ, would easily be introduced into the said countries and islands. Also, on one of the chief of these aforesaid islands the said Christopher has already caused to be put together and built a fortress fairly equipped, wherein he has stationed as garrison certain Christians, companions of his, who are to make search for other remote and unknown islands and mainlands. In the islands and countries already discovered are found gold, spices, and very many other precious things of divers kinds and qualities. Wherefore, as becomes Catholic kings and princes, after earnest consideration of all matters, especially of the rise and spread of the Catholic faith, as was the fashion of your ancestors, kings of renowned memory, you have purposed with the favor of divine clemency to bring under your sway the said mainlands and islands with their residents and inhabitants and to bring them to the Catholic faith. Hence, heartily commending in the Lord this your holy and praiseworthy purpose, and desirous that it be duly accomplished, and that the name of our Savior be carried into those regions, we exhort you very earnestly in the Lord and by your reception of holy baptism, whereby you are bound to our apostolic commands, and by the bowels of the mercy of our Lord Jesus Christ, enjoin strictly, that inasmuch as with eager zeal for the true faith you design to equip and despatch this expedition, you purpose also, as is your duty, to lead the peoples dwelling in those islands and countries to embrace the Christian religion; nor at any time let dangers or hardships deter you therefrom, with the stout hope and trust in your hearts that Almighty God will further your undertakings. 'Beauty, richness of the thought of Pope Benedict' in new encyclical

The encyclical Lumen Fidei gives us one final opportunity to receive authorative teaching that has the beauty and richness of the thought of Pope Benedict XVI, says Bishop Julian Porteous, auxillary bishop of Sydney.

The new encyclical focuses on the light of faith, and brings together thinking of Pope Benedict XVI and Pope Francis.
"Pope Benedict XVI was already aware of the importatnce of faith," said Bishop Porteous.
"He saw it asa a great issue facing the western world at the present moment.
"Thoughtful his pontificate he so often, along with reason, as the means by which western civilisation can really preserve its true character and contribution to society.
"This encyclical completes the triology of encyclicals on charity, hope and faith. It's also, of course, linked to the fact that Pope Benedict had a Year of Faith again highlighting how important he saw faith as an issue in the world today.
"With this encyclical we again have the opportunity of savouring the beautiful style and presentation of Pope Benedict, even though it's issued under the name of Pope Francis.
"The bulk of the encyclical clearly has the mark of Pope Benedict."
Archbishop Philip Wilson, vice-president of the Australian Catholic Bishops Conference, pointed to paragraph 24 as among the most beautiful passages in the new encyclical which explains well its premise.

"We need knowledge, we need truth, because without these we cannot stand firm, we cannot move forward. Faith without truth does not save, it does not provide a sure footing. It remains a beautiful story, the projection of our deep yearning for happiness, something capable of satisfying us to the extent that we are willing to deceive ourselves."

"In saying, the encyclical says that the light of faith does not stand alone, but is accompanied by truth and knowledge," said Archbishop Wilson.
